Arbitration Practice
Many contracts have clauses requiring that disputes that cannot be settled between the parties must be resolved through binding arbitration or another method of alternative dispute resolution (ADR).  Arbitration is essentially a more streamlined version of the court process.  The parties proceed under a set of rules (such as established by the American Arbitration Association) and eventually their case is heard and ruled on by a private arbitrator.  The process is often quicker than litigation because case loads at many courts are backed up for well over a year.  The arbitrator's fees can be substantial, so lawyers must evaluate whether the arbitration will, in fact, save money, or whether they should attempt to move the matter to the courts.

Mediation Practice
Unlike litigation or arbitration, the mediation process involves the use of a neutral third party to help resolve a dispute, with making any sort of binding decision or determination themselves. Typically, a third party, the mediator, assists the parties to negotiate a settlement. The term "mediation" broadly refers to any instance in which a third party helps others reach agreement. The process is private, may be confidential, may be enforced by the courts under certain circumstances.  Although participation is typically voluntary, most courts require that parties to a lawsuit attempt mediation long before a trial is conducted. Court-ordered mediation resolves a large majority of cases in many jurisdictions.  Genser & Watkins attorneys have been involved in hundreds of
private, voluntary, and court-ordered mediations.
